Slip-and-Fall Accidents

"Slip, trip and fall" accidents oftentimes happen due to a dangerous or unreasonable condition on someone else's property. The fall can take place inside or outside of the property. Our clients, some of whom have broken their wrists, arms, backs (fractured and bulging discs), hips and legs, have received large recoveries as a result of the being injured by the following hazardous conditions:

  • Uncleared snow
  • Clear or black ice
  • Liquids on floors
  • Uneven sidewalks and or holes in parking lots
  • Improperly secured mats and rugs
  • Hidden drop-offs
  • Pot holes

A claim for damages can also result if:

  • If the business or owner does not maintain the property or allows a condition to exist that is dangerous and causes someone to fall.
  • If the business or owner knows of a dangerous condition, or should know of it, but does nothing to make it safe, to eliminate the problem, to provide a warning, or to erect a barrier.

One of the most important tasks when an accident happens is to gather essential evidence immediately. It is not uncommon for key evidence to disappear or for conditions to change. You must act swiftly.

If you can, or if you have a friend or neighbor that can:

  • Be sure to take photographs of the area and the condition that caused the fall
  • Report the accident and the condition to the business or property owner and fill in an incident report or other written document that describes what happened
  • If there are witnesses, make sure you have their names and phone numbers
  • You should always look to see if there are security cameras that may have recorded the fall

Slip, trip and fall accidents are common in Utah. We have had excellent success in this area of premises liability. Business owners and land owners have a duty to provide a safe environment for their customers and their visitors and when they fail to meet that duty serious injuries such as broken bones, back injuries, head trauma and even fatalities can result.

Act now because time is important! Each type of injury has a strict time limit set by Utah law on when legal action may be filed with the court. If you fail to meet that deadline, you are forever stopped or barred from bringing your claim.

If you've been injured in a fall, your medical care comes first. We are ready to assist you with the legal end and to hold landowners and businesses responsible for their negligence. We will protect your legal rights.
